Please carefully review these Terms and Conditions before placing your order. By making a purchase, you acknowledge and agree to be bound by the following terms and conditions:

Purchase Agreement:

1.1 All sales are final. Once an order is placed and payment is processed, it cannot be cancelled, refunded or exchange. We kindly request that you review your order carefully before completing the purchase.

1.2 By placing an order, you confirm that you have thoroughly reviewed and verified all the details, including product specifications, pricing, and shipping information. It is essential to ensure accuracy and avoid any inconvenience for both parties.

1.3 Cancellation of order is not allowed once payment is made and successful.

1.4 Any cancellation request may be turned down at our sole discretion. In the event of any disagreements, our determination shall be final and conclusive.

Minimum Purchase Requirement:

2.1 To qualify for free shipping, the total value of eligible items in your cart must be RM150 or above, excluding any taxes, discounts, or additional charges. This is only applicable for West Malaysia.

Pre-Order Items:

3.1 Some products may be offered as pre-order items, allowing you to reserve and purchase them in advance before they become available for regular sale.

3.2 When placing a pre-order, please note that the full purchase amount will be charged immediately to secure your reservation. This enables us to manage the production and logistics accordingly.

3.3 The estimated release date provided for pre-order items is subject to change due to factors beyond our control. While we make every effort to fulfil the estimated timeline, we appreciate your understanding if there are any unforeseen delays.

3.4 Once a pre-order item is placed, it is not eligible for refunds or cancellations. We kindly ask for your patience and cooperation in waiting for the product to become available.

Product Availability:

4.1 All products are subject to availability. Although we strive to keep our inventory up to date, there may be instances where a product becomes unavailable after you have placed an order.

In such cases, we will promptly notify you and offer an alternative or a refund. While we make every effort to avoid such situations, we appreciate your understanding and flexibility in finding a suitable resolution.

**All promotions are exclusive to the website and may differ from those offered at department stores or retail locations.

Shipping and Delivery:

5.1a Our estimated shipping and delivery timeframe is between 7 to 14 business days, excluding weekends and public holidays, from the date of order confirmation.

5.2a Please note that delivery times are approximate and may vary due to factors beyond our control, such as shipping carrier delays, weather conditions, or unforeseen circumstances. While we strive to ensure timely delivery, we cannot be held liable for any delays.

5.3a During the checkout process, shipping costs, including any applicable taxes or customs duties, will be calculated and added to the total order amount. To ensure accurate and prompt delivery, please provide us with correct and complete shipping information.

5.4a Abuse of Shipping Fee System: Customers are required to provide accurate information regarding their shipping location. Abuse of the system, including but not limited to, falsely stating their location to take advantage of lower shipping fees, will not be tolerated.

5.5a Verification of Shipping Location: We reserve the right to verify the shipping location provided by customers. In cases where discrepancies are found between the provided location and the actual shipping destination, we may hold the order until the correct shipping fee is paid.

5.6a Additional Payment for Correct Shipping Fee: If it is determined that the customer has provided false information regarding their shipping location, they will be required to pay the remaining balance of the correct shipping fee before their order is processed and shipped.

5.7a Order Hold: Orders may be held until the correct shipping fee is paid. We will notify customers via the contact information provided during checkout regarding any discrepancies and the actions required to proceed with their order.

Non-Delivery:

5.1b In the rare event that your order does not arrive within the estimated delivery timeframe, please contact our customer support team for assistance. We will make reasonable efforts to track and locate your package.

5.2b If your order is confirmed as undeliverable, returned to us, or lost in transit due to reasons beyond our control, we will provide you with a refund for the purchase price. However, if the order was undeliverable or returned due to an incorrect or incomplete address provided by the customer, the customer will be responsible for the shipping fees incurred for us to resend the order.

Damaged or Defective Products:

6.1 We strive to deliver products in perfect condition. However, if you receive a damaged or defective item, please notify us within 48 hours of receiving the parcel and provide supporting evidence, such as photographs or videos. Prompt notification allows us to address the matter efficiently.

6.2 We may request the return of the damaged or defective product, at our discretion, for inspection and verification purposes. We kindly request that you retain the packaging of the damaged or defective product for inspection and verification purposes when we arrange for its return. This will ensure that the product is appropriately packaged during the collection process.

6.3 Upon confirmation of a genuine claim, we will either replace the product or issue a refund, including any applicable shipping fees. Your satisfaction is important to us, and we will work diligently to resolve any issues.

Governing Law:

7.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of [The Consumer Protection Act 1999 (CPA)]. We aim to operate within the legal framework to ensure fairness and transparency in all our transactions.

Liability and Indemnity:

We take our responsibility seriously and strive to provide the best service possible. However, there are certain limitations to our liability. Please take note of the following:

8.1 LA GOURMET will use reasonable endeavors to verify the accuracy of information on the site. However, we make no representation or warranty, express or implied, statutory or otherwise, regarding the contents or availability of the site. We cannot guarantee that the site will be timely or error-free, that defects will be corrected, or that the site or the server making it available are free of viruses or bugs. While we make every effort to ensure the full functionality and accuracy of the website, LA GOURMET will not be responsible or liable for any loss of content or material uploaded or transmitted through the website. We accept no liability for any loss or damage arising from actions taken or taken in reliance on material or information contained on the site.

8.2 Except as expressly provided in these terms and conditions with respect to specific products, LA GOURMET excludes any indemnities, warranties, terms, and conditions, whether express or implied, to the fullest extent permitted under applicable law, except for your statutory rights as a consumer and your contract cancellation rights.

8.3 LA GOURMET will not be liable, in contract, tort (including, without limitation, negligence), pre-contract, or other representations (other than fraudulent or negligent misrepresentations), or otherwise, out of or in connection with the terms and conditions for any:

– Economic losses (including without limitation loss of revenues, data, profits, contracts, business, or anticipated savings)

– Loss of goodwill or reputation

– Special or indirect losses

– Such losses or damages suffered or incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions.

8.4 Notwithstanding the above, LA GOURMET’s aggregate liability (whether in contract, tort, or otherwise) for loss or damage shall, in any event, be limited to a sum equal to the amount paid or payable by you for the product(s) in respect of one incident or series of incidents attributable to the same clause.

8.5 Please note that the provisions mentioned in clause 7 do not affect your statutory rights as a consumer, nor do they affect your contract cancellation rights.

8.6 While we take all reasonable precautions to keep your order and payment details secure, we cannot be held liable for any losses caused by unauthorized access to the information provided by you unless we are negligent.

Warranty Policy:

9.1 LA GOURMET is not obligated to repair or replace any product that lacks a valid proof of purchase. For product returns, customers can choose to either visit LA GOURMET’s Head Office in Subang Jaya, Malaysia, in person or ship the product back in suitable packaging via recorded delivery (or an equivalent postage method). The cost of shipping is the responsibility of the customer.

9.2 As an alternative, customers may also contact the designated customer service number as advertised on the website. This guarantee applies solely to products purchased and used for domestic purposes. It does not extend to damage resulting from misuse, negligence, failure to adhere to product guideline instructions, unauthorized modification or repair, inadequate packaging by the owner, or mishandling by any carrier.

9.3 Additionally, this guarantee does not encompass normal wear and tear, maintenance or replacement of consumable parts, nor does it cover the following scenarios:

  1. Damages or subpar results specifically caused by using the wrong voltage or frequency, as indicated on the product ID or specifications.
  2. Usage of incorrect water type or consumables.
  3. Mechanical damages or harm arising from lightning or power surges.
  4. Damage to any glass or porcelain components within the product.
  5. Accidents, including fires, floods, etc., resulting from professional or commercial use.

9.4 The exchange process will take up to 7-14 working days from the date we received the defect item.

Coupon Redemption:

10.1 To redeem the promotion, eligible customers must enter the specified promo code at the time of checkout for online purchases.

10.2 The promotion will be applied at the point of sale when the eligible subtotal is reached.

10.3 The promotion is non-transferable and has no cash value.

10.4 Some promo codes or coupons are exclusive to either retail or online purchases. Please refer to the specific terms associated with each promo code for eligibility.
